Those of you following the draft legislative proposals in Ireland on legal capacity should read the amicus brief lodged by the European Group of National Human Rights Institutions (Ombudsman, human rights commissions, etc) to the European Court of Human Rights earlier in 2008. Among other things the brief goes into Article 12 of the UN Convention on the Rights of Persons with Disabilities and then opens up comparative law trends in Europe. It is useful reading to anyone interested in getting a vantage point from which to assess the Irish draft proposals.
